By registering for this auction sale The bidders(s) and the Auctioneer(s) agree to the terms and conditions listed below (Terms and Conditions are also posted at www.shackletons.ca) All registration information the Bidder provides to the Auctioneer shall be current, complete, and accurate. All bidders must be 18 years of age or older. The bidder agrees to not use any device, software or routine to interfere or attempt to interfere with the proper working of any transaction being conducted on and during any auction sale. Settlement for payment for purchases can be made by Visa/Mastercard or E-Transfer. All sales are subject to a 15% Buyer's Premium and 13% HST (Harmonized Sales Tax) if applicable. If you are exempt from paying sales tax you must provide the Auctioneer a copy of your license or fill out a tax exemption form prior to the closing of the sale. Full settlement to be made at the conclusion of the sale. Nothing is removed until paid in full, and invoice received. 2. Buyer acknowledges and agrees not to retract their bids. The Highest Bidder shall be the Buyer, and if any dispute arises during the Sale, then the Auctioneer, may at his discretion, put the Lot up again. The Auctioneer's decision is final. The Auctioneer reserves the right to accept or reject any bid and shall control the bidding at all times. 3. Buyer shall be responsible for making all arrangements for merchandise pick-up and /or removal per specific terms or conditions listed for auction. Please bring your own manpower for loading & moving items, boxes and packaging paper for packaging items. a. THE ITEMS HAVE BEEN DISPLAYED AND EACH BUYER SHALL BE HELD TO HAVE SATISFIED HIMSELF AS TO THE CONDITION, IDENTITY AND AUTHENTICITY, AND SHALL NOT BE PERMITTED TO MAKE ANY OBJECTIONS AFTER THE SALE ON ANY GROUNDS WHATSOEVER. NEITHER THE AUCTIONEER NOR THE OWNER IS RESPONSIBLE FOR ANY ERROR ON CONDITIONS OF ITEMS. 5. ALL ITEMS ARE SOLD "AS IS, WHERE IS". The Owner/Sellers of property sold through this Site reserve the right to reject any and all bids in their sole discretion. If there is a reserve on a lot, the Auctioneer and/or the Seller have the right to bid on behalf of the Seller. 7. Merchandise becomes the full responsibility of the Buyer at time of PAYMENT. Any Buyer having someone, other than himself, pick-up his purchases must notify the Auctioneer. Buyer shall be at his own risk and liability at the Owners' property for pick ups, and shall hold the Owner/Seller and the Auctioneer harmless for the Buyer's negligence. Buyer shall also be held responsible for any damage to the Owner's property, caused by the Buyer. 8. Auctioneer reserves the right to resell any property not paid for in full with all funds received by Auctioneer within two days on the online auction item/lots closing date. Failure to pay for item/lots won on this online auction may result in legal action against Buyer. 9. Auctioneer cannot, and will not, be held responsible for any interruption in service, errors and/or omissions, caused by any means and does not guarantee continual, uninterrupted or error free service or use of the Site. Bidder acknowledges that this auction is conducted electronically and relies on hardware and software that may malfunction without warning. The Auctioneer, in its sole discretion, may void a sale, temporarily suspend bidding and re-sell any items/lots that were affected by any malfunction. The decision of the Auctioneer is final. 10. Auctioneer gathers information about Bidders and Owners/Sellers for the purposes of conduction online auctions only. Auctioneer does not, and will not, sell or rent this information. 11. Auctioneer uses email mailing lists to notify its customers about online and live auctions. If you are receiving a particular mailing and wish to discontinue receiving future mailings, simply forward the received email to Auctioneer to have your name removed from our list. 12. As a Bidder you are responsible for any bids placed under your bidding number and password. The security of your Bidder information is your sole responsibility as you, the Bidder, will be responsible for any and all bids placed under your number. If at any time you feel that your Bidder number and password have been compromised due to lack of security on your part you must notify Auctioneer immediately. 13. By using this site, you, the Bidder, agree in advance to accept all rules, terms, and conditions, and any such possible changes thereto. 14. Visa, Mastercard or E-Transfer (for the time being, we are no longer accepting payment by Cash, Debit or VisaDebt cards) 15% Buyer's Premium and 13% HST is in effect (if applicable) If you are a successful bidder an invoice will be emailed to you (from auction@shackletons.ca) upon the closing of the auction. If you do not receive an email, please check your spam/junk box before calling the office (519-271-2646) to enquire. Immediately after the sale has closed, you will be sent an UNPAID invoice. Once you receive this invoice, you will need to reply to the email letting us know how you would like to proceed with payment. Option #1 is we charge your Visa/Mastercard card on file, option #2 is you send an e-transfer for the total amount outstanding on your invoice. If you don't let us know which option you would like by 9:00am EST, we will automatically charge your card on file. All E-Transfer payments can be sent to auction@shackletons.ca and if applicable, please use the password: auctionshack. E-Transfer payments must be received no later than 9:00am EST on Thursday, July 16th, 2020, otherwise the credit card on file will automatically be charged. If your credit card is declined, we will email you to let you know, and it will be your responsibility to make good on your payment within 6 hours of our initial email. Failure to make good on payment will result in being banned from all future online auctions and being banned from other auctions on Hi-Bid. ALL ITEMS MUST BE PAID IN FULL BEFORE YOU CAN PICK-UP OR HAVE YOUR ITEMS DELIVERIED OR SHIPPED TO YOU. We cannot accept cash or debit payments upon pick-up. If you wish to have your items delivered (to Stratford, Ontario only, and excludes furniture) there will be a $10 service fee/handling fee applied to your total invoice. CONTACTLESS CURBSIDE PICK-UP: Pick-up is available at Shackleton's Real Estate and Auction Co. (3715 Embro Road, STRATFORD, Ontario, N5A 6S3) on Thursday, July 16th and Friday, July 17th from 8:00am - 6:00pm. Please follow the pylon lane to the back of our building. Once you get to the back door we will ask you for your last name and our staff will collect your items for you and place them in your vehicle. If you are the successful bidder of smaller items that need to be packed, our staff will bring your items to you at a table where you can pack your item and return to your vehicle. If you are picking up furniture you will be permitted into our building to be able to move your furniture to your vehicle - please wear a mask. Tables will be wiped down and sanitized after each customer. We are only able to assist 2 vehicles at a time, you might have to wait in your vehicle before you can pick-up your items, please be patient. Do not call us to let us know that you are here, just remain in your vehicle and we will get to you when we can. In Order to reduce the risk of spreading COVID-19, we ask that you reconsider coming to pick-up your items if any of the following reflects how you are feeling at the time of pick-up: 1. If you should be self-isolating as a result of possible exposure to COVID-19 within the last 14 days. 2. If you have one or more of the following symptoms: fever/chills, cough, shortness of breath, loss of taste or smell, sore throat/hoarse voice 3. If you have had contact with a person who has had a confirmed case of COVID-19 4. If you have traveled within the past 14 days outside of the province of Ontario Should any of these apply to you, we are happy to make alternate pick-up arrangements. If you are having a friend or family member pick-up your items for you, please email us (auction@shackletons.ca) to notify us. If you are unable to come and pick-up your items, we invite you to make arrangements to get your item(s) either delivered (if you live in Stratford,Ontario) or shipped to you. DELIVERY: We are offering porch side delivery to any successful buyer located in STRATFORD, ONTARIO. There is a $10 fee associated with this service that will be added onto your total invoice amount. Your invoice must be PAID in full before your items can be delivered to you. Deliveries will occur between 8:00am - 6:00pm on July 16th and 17th, and excludes Furinture. SHIPPING If you would like to arrange shipping, please email auction@shackletons.ca with the address you would like your items shipped to. There is a $10 packing fee per box/lot + shipping costs determined by the shipping company. Canadian Shipping is provided by various 3rd party shipping companies (ex. Loomis Express, Purolator, Dicom, etc.), for International Shipping (including shipping to the US) we use Canada Post. *Please note that shipping is not available on all items. All shipping costs will be charged at the buyer's expense. Please note that we have received updated from our shipping partners and due to the growing concerns around COV-19, shipping may be delayed slightly and carriers will not be collecting signatures at the time of delivery Won lots, will be shipped out within 7 business days of the auction closing.
