Auction Terms & Conditions By registering for this auction sale The bidders(s) and the Auctioneer(s) agree to the terms and conditions listed below (Terms and Conditions are also posted at www.shackletons.ca) All registration information the Bidder provides to the Auctioneer shall be current, complete, and accurate. All bidders must be 18 years of age or older. The bidder agrees to not use any device, software or routine to interfere or attempt to interfere with the proper working of any transaction being conducted on and during any auction sale. Sale starts Wednesday, May 6th at 6:00pm EST Sale closes Wednesday, May 13th at 6:00pm EST with a 3 minute soft close in effect. 15% buyers premium and 13% HST is in effect (if applicable) There is NO in-person Preview for this Auction, due to COVID-19 health and saftey measures outlined by the Province of Ontario. 1. Settlement for payment for purchases can be made by Visa/Mastercard or E-Transfer. All sales are subject to 13% HST (Harmonized Sales Tax). If you are exempt from paying sales tax you must provide the Auctioneer a copy of your license or fill out a tax exemption form. All sales are subject to a 15% Buyer's Premium of the Purchase Price and payable by the Buyers. Full settlement to be made at the conclusion of the sale. Nothing is removed until paid in full, and invoice received. 2. Buyer acknowledges and agrees not to retract their bids. The Highest Bidder shall be the Buyer, and if any dispute arises during the Sale, then the Auctioneer, may at his discretion, put the Lot up again. The Auctioneer's decision is final. The Auctioneer reserves the right to accept or reject any bid and shall control the bidding at all times. 3. Buyer shall be responsible for making all arrangements for merchandise pick-up and /or removal per specific terms or conditions listed for auction. Please note that some removal times are short, be aware of removal times when you bid. Please bring your own manpower for loading & moving items, boxes and packaging paper for packaging items. a. THE ITEMS HAVE BEEN DISPLAYED AND EACH BUYER SHALL BE HELD TO HAVE SATISFIED HIMSELF AS TO THE CONDITION, IDENTITY AND AUTHENTICITY, AND SHALL NOT BE PERMITTED TO MAKE ANY OBJECTIONS AFTER THE SALE ON ANY GROUNDS WHATSOEVER. NEITHER THE AUCTIONEER NOR THE OWNER IS RESPONSIBLE FOR ANY ERROR ON CONDITIONS OF ITEMS. 5. ALL ITEMS ARE SOLD "AS IS, WHERE IS". ONCE THE ITEM IS SOLD, THE BUYER SHALL ASSUME FULL RISK AND RESPONSIBILITY FOR THE ITEM. 6. Despite efforts to avoid withdrawal of item/lots from the sale after they are listed it may sometimes be necessary. Auctioneer and the Owner/Seller reserve the right to do so at any time before or during the sale. The Owner/Sellers of property sold through this Site reserve the right to reject any and all bids in their sole discretion. If there is a reserve on a lot, the Auctioneer and/or the Seller have the right to bid on behalf of the Seller. 7. Merchandise becomes the full responsibility of the Buyer at time of PAYMENT. Any Buyer having someone, other than himself, pick-up his purchases must notify the Auctioneer. Buyer shall be at his own risk and liability at the Owners' property for pick ups, and shall hold the Owner/Seller and the Auctioneer harmless for the Buyer's negligence. Buyer shall also be held responsible for any damage to the Owner's property, caused by the Buyer. 8. Auctioneer reserves the right to resell any property not paid for in full with all funds received by Auctioneer within two days on the online auction item/lots closing date. Failure to pay for item/lots won on this online auction may result in legal action against Buyer. 9. Auctioneer cannot , and will not, be held responsible for any interruption in service, errors and/or omissions, caused by any means and does not guarantee continual, uninterrupted or error free service or use of the Site. Bidder acknowledges that this auction is conducted electronically and relies on hardware and software that may malfunction without warning. The Auctioneer, in its sole discretion, may void a sale, temporarily suspend bidding and re-sell any items/lots that were affected by any malfunction. The decision of the Auctioneer is final. 10. Auctioneer gathers information about Bidders and Owners/Sellers for the purposes of conduction online auctions only. Auctioneer does not, and will not, sell or rent this information. 11. \Auctioneer uses email mailing lists to notify its customers about online and live auctions. If you are receiving a particular mailing and wish to discontinue receiving future mailings, simply forward the received email to Auctioneer to have your name removed from our list. 12. As a Bidder you are responsible for any bids placed under your bidding number and password. The security of your Bidder information is your sole responsibility as you, the Bidder, will be responsible for any and all bids placed under your number. If at any time you feel that your Bidder number and password have been compromised due to lack of security on your part you must notify Auctioneer immediately. 13. By using this site, you, the Bidder, agree in advance to accept all rules, terms, and conditions, and any such possible changes thereto. 14. Shackleton's Real Estate & Auction Co. is acting as Agent for the Seller. 15. The auction will start to close at 6:00pm. With 10 second increments between each lot. 16. What does "SOFT CLOSE" mean? Any bids placed in the last minute of the lot closing will cause the auction item to stay open for an additional 3 minutes. This will continue until all bidding has ceased. 17. What is "MAXIMUM BIDDING"? Bidders may place a maximum bid on each item. Your initial bid will increase automatically, each time you are outbid, up to your maximum bid. If a competing bid is above your maximum bid, you will be required to bid online again, if you want to be the successful bidder. 18. Any items purchased and not picked up within the final removal date will be considered deemed and abandoned and will be disposed of at the Auctioneers discretion. a. All items not picked up by 6:00pm on Friday, May 15th will be deemed abandoned and will become the property of Shackleton's Real Estate and Auction Co. Visa, Mastercard or E-Transfer (for the time being, we are no longer accepting payment by Cash, Debit or VisaDebt cards) 15% Buyer's Premium and 13% HST is in effect (if applicable) If you are a successful bidder an invoice will be emailed to you upon the closing of the auction. If you do not receive an email, please check your spam/junk box before calling the office to enquire. Immediately after the sale has closed, you will be sent an UNPAID invoice. Once you receive this invoice, you will need to reply to the email letting us know how you would like to proceed with payment. Option #1 is we charge your Visa/Mastercard card on file, option #2 is you send an e-transfer for the total amount outstanding on your invoice. All E-Transfer payments can be sent to shack@shackletons.ca and if applicable, please use the password: auctionshack. E-Transfer payments must be received no later than 12:00pm EST on Thursday, May 14th, 2020, otherwise the credit card on file will automatically be charged. ALL ITEMS MUST BE PAID IN FULL BEFORE YOU CAN PICK-UP OR HAVE YOUR ITEMS DELIVERIED OR SHIPPED TO YOU. We cannot accept cash or debit payments upon pick-up. If you wish to have your items delivered or shipped there will be a $10 service fee/handling fee applied to your total invoice. CONTACTLESS CURBSIDE PICK-UP: Pick-up is available at Shackleton's Real Estate and Auction Co. (3715 Embro Road, STRATFORD, Ontario, N5A 6S3). Please drive around to the back of the building to the first bay door. When you arrive please notify us of your last name, and we will collect your items for you and bring them to a table where you can pack your items and return to your vehicle. We are only able to assist 1 vehicle at a time. Remain in your vehicle until it's your turn Pick-up for this sale is available: Thursday, May 14th from 8:00am - 6:00pm and Friday, May 15th from 8:00am - 6:00pm (2 Days Only) In Order to reduce the risk of spreading COVID-19, we ask that you reconsider coming to pick-up your items if any of the following reflects how you are feeling at the time of pick-up: 1. If you have had a fever at some point in the past 24 hours 2. I have one or more of the following symptoms: fever, cough, shortness of breath, sore throat, runny nose 3. I have had contact with a person who has had a confirmed case of COVID-19 4. I have traveled within the past 14 days Should any of these apply to you, we are happy to make alternate pick-up arrangements. If you are having a friend or family member pick-up your items for you, please email us (auction@shackletons.ca) to notify us. DELIVERY: We are offering porch side delivery to any successful buyer located in STRATFORD, ONTARIO. There is a $10 fee associated with this service that will be added onto your total invoice amount. Your invoice must be PAID in full before your items can be delivered to you. Deliveries will occur between 8:00am - 6:00pm on May 14th and 15th, and excludes Furinture. SHIPPING Shipping of your items is highly encouraged! If you would like to arrange shipping please email auction@shackletons.ca with the address you would like your items shipped to. There is a $10/per box handling fees + shipping costs provided by the shipping company. Canadian Shipping is provided by various 3rd party shipping companies (ex. Canpar, Loomis Express, Purolator, Dicom, etc.), for International Shipping we will use Canada Post. *Please note shipping of larger paintings (typically any work the frame size of which exceeds 81cm square or 32 x 32in) is not available through Canada Post. Please contact our office prior to bidding for more information. All shipping costs will be charged at the buyer's expense. Please note that we have received updated from our shipping partners and due to the growing concerns around COV-19, shipping may be delayed slightly and carriers will not be collecting signatures at the time of delivery Won lots, will be shipped out within 5 business days of the auction closing.
